DUBOIS – During a traffic stop, DuBois City police allegedly found a Luthersburg man was in possession of methamphetamine, marijuana, a gun and $3,000 in cash.
Michael Robert Kelly, 40, is now facing felony counts of possession of firearm prohibited, altering/obliterating mark of identification, firearms not to be carried without a license, manufacture/delivery/possession with intent to deliver a controlled substance and dealing in proceeds of unlawful activities, as well as three misdemeanor counts of intentional possession of a controlled substance and one count of possession of drug paraphernalia.
Kelly, incarcerated on $500,000 bail, is scheduled for a preliminary hearing Friday.
According to the affidavit of probable cause, on March 27 police pulled over a Ford Mustang with a registration belonging to a Dodge vehicle. The driver who was identified as Kelly told the officer that he had just purchased the vehicle and did not have any paperwork to show him.
When the officer ran the vehicle identification number, the information indicated the vehicle belonged to someone in Arizona.
Kelly was asked to step out of the vehicle and was advised of his rights. He was asked if there were any weapons, cash, drugs or anything else in the car and he said there was nothing.
He consented to a search of the vehicle and then reportedly admitted there was some marijuana in the car.
When he was searched, an officer allegedly found a bag of methamphetamine in his left pocket and $3,000 in his right pocket.
Officers reportedly found a cooler bag in the trunk with two separate bags of marijuana, a small box that contained two stamp bags of heroin, 35 grams of marijuana and 13 grams of methamphetamine. Police also found a loaded pistol that had its serial number scratched off, according to the complaint.
When he was interviewed by police at the police station, he reportedly admitted he was a meth addict and that he sells both meth and heroin.
Due to a prior conviction, Kelly is not permitted to possess a firearm.
The passenger in the car, Alexandra Leighann Sheets, 27, of Luthersburg was also carrying drugs, according to her criminal complaint.
Police say she had a small baggie of meth in her wallet, five used syringes and two stamp backs of heroin inside a cosmetic case.
She is charged with two misdemeanor counts of intentional possession of a controlled substance and possession of drug paraphernalia.
She is also incarcerated on $5,000 bail with her preliminary hearing is scheduled for Friday.
