DUBOIS – Terry Mills of Dubois waived his right to a preliminary hearing before Magisterial District Judge Patrick N. Ford Friday.
Mills, 26, was before the judge for an incident that occurred on Sept. 4 at 81 Oklahoma Salem Road. The affidavit of probable cause states that on that day a neighbor observed two juveniles damage a residence that bordered the neighbor’s property. The complainant believed the juveniles lived at apartments on Hanes Drive.
Police spoke to Mills, who resides at Hanes Drive, just south of the damaged residence. Mills related to police that he was aware of several juveniles who have been known to frequent the property.
According to the affidavit of probable cause, several interviews concluded that Mills and two juvenile accomplices were at the damaged residence. Statements to police indicate that the three planned to break into the residence to play “air gun wars.” They gained entry by kicking in a rear door. Mills reportedly supplied the air pistols to several juveniles.
Reports indicate that Mills and his accomplices used golf clubs to break windows and walls, kicked in all interior and exterior doors, and used a variety of blunt objects to to damage the residence. One object found was a propane tank, lodged in an interior wall. A ceiling fan was found ripped out of the ceiling, two French doors were smashed, and washing detergent was dumped on the carpeted floor.
Damage to the property is estimated at $28,336.
Mills waived charges of criminal trespass, defiant trespass of fenced or enclosed, criminal mischief, corruption of minors, sales and or use of air rifles, and criminal conspiracy to commit defiant trespass. Mills is free on unsecured bail.
