Son Accused of Stealing from Hospitalized Father

DUBOIS – A son is accused of stealing money from his hospitalized father.

According to an affidavit of probable cause filed with District Judge Patrick Ford’s office, Timothy W. Mayes Jr., 50, 1856 Continental Dr., Rockton, is charged by the DuBois-based state police with theft by unlawful taking or disposition and receiving stolen property.

According to the affidavit, troopers with the criminal investigative unit spoke to the victim Aug. 22. The victim told the troopers that he had a heart attack and was taken to UPMC Presbyterian Hospital in Pittsburgh to have surgery.

The victim told the troopers he had called Mayes to tell him where the bank book was. The victim said he told Mayes there was about $7,000 in the bank and if he passed away, Mayes could have the money. The victim said in 1996, Mayes had jointly signed on to a savings account at both of the victim’s banks.

The victim said after his surgery, he called Mayes to tell him everything had gone well, and the victim said Mayes allegedly told him that he was hoping the victim would have died.

The victim said he was transferred to the VA hospital in Altoona after his surgery and Mayes came to visit on Memorial Day. The victim said Mayes had allegedly asked to borrow $1,800 to fix his Jeep and that Mayes would pay the victim back in three months.

The victim said he was released from the hospital June 27 and noticed both of his accounts had a significant amount of money withdrawn from them. The victim said he tried to contact Mayes multiple times but Mayes refused to talk to him. The victim said he went to Mayes’ house to talk about the problem. The victim said Mayes allegedly returned the bank book but not the money.

The bank books showed that on May 14, Mayes allegedly transferred $2,407 from the victim’s account into Mayes’ account. On May 19, Mayes allegedly withdrew $2,000 from the account he had deposited the victim’s money into.

Mayes allegedly signed and dated a cash withdrawal slip on May 15 in the amount of $3,002 from the victim’s account. The troopers noted that the withdrawals were made while the victim was recovering at the hospital and prior to Mayes asking to borrow $1,800.

The troopers spoke to Mayes, who allegedly admitted to withdrawing more than $5,000 from the victim’s account. Mayes allegedly told the troopers that he used $300 to fix the victim’s vehicle, another $1,800 to fix his Jeep and there rest of the money to pay his bills. Mayes said the victim allegedly told Mayes that his money was Mayes’ money.
