CLEARFIELD – A Schnecksville man accused of causing a disturbance at a local establishment and then resisting police waived his right to a preliminary hearing on Wednesday during Centralized Court at the Clearfield County Jail.
Charles M. Flynn Jr., 53, of Schnecksville has been charged with aggravated assault, resisting arrest, disorderly conduct and simple assault. His bail was set at $50,000, which he’s posted.
According to the affidavit of probable cause, Officer Elliott Neeper of the Lawrence Township police received a report about a disturbance on Jan. 29 at Denny’s Beer Barrel Pub. While en route, Neeper was advised a male, Flynn, was extremely intoxicated and causing a verbal disturbance.
Upon his arrival, an employee met Neeper and directed him to Flynn. The male was described to Neeper as being “irrational,” and impaired to the extent that he couldn’t communicate clearly. The employee advised that Flynn was irritated and vulgar and threatened to become physical with others and remained verbally oppositional with staff.
Flynn, the affidavit states, was observed slouched over in his chair. Neeper approached Flynn asking what the problem was to which he replied, “Who are you, expletive off.” At that point, Neeper asked Flynn to step outside with him due to his behavior and to do so without alarming patrons. Flynn refused, saying he was going to call his attorney.
Neeper then requested Clearfield Borough police to assist with removing Flynn from the establishment. Flynn allegedly continued to be disruptive and repeatedly cursed at anyone who attempted to speak with him. Officer John Brown of the Clearfield Borough police arrived and attempted to escort Flynn out of the establishment with Neeper.
Flynn allegedly resisted officers by stiffening his body to the point that they had to drag him up stairs and outside. Flynn continued to resist officers in the parking lot and attempted to grab both officers’ gun belt.
As a result, Neeper and Brown took Flynn to the ground for their own protection and Flynn from injury. Flynn was subsequently cuffed but continued to be very belligerent and disruptive. After standing up Flynn, Neeper and Brown observed a small amount of blood on his nose and forehead area.
Flynn allegedly proceeded to threaten both Neeper and Brown, stating he would kill them. Flynn spit on Brown. Officers requested emergency personnel to evaluate Flynn. Neeper and Brown had to restrain Flynn, while he allegedly refused to cooperate with paramedics and stated he “knew people in Harrisburg who would get him out of trouble.”
After being medically cleared at the scene, Flynn was taken back to the patrol vehicle. Flynn claimed to be in pain and was removed from the vehicle. Flynn then refused to get back in and had to be forcibly put in the patrol vehicle.
Flynn laid down across the seat and kicked Brown’s face. Brown started to react but was pulled away in order to close the door of the patrol vehicle. Flynn was transported to the CCJ and taken into custody.
