CLEARFIELD – A Clearfield man accused of growing marijuana in his backyard waived his right to a preliminary hearing on Wednesday.
Robert L. Miller Jr. is charged with six counts of possession with intent to deliver a controlled substance, six counts of possession of drug paraphernalia, and six counts of possession of a controlled substance.
According to court records on Aug. 5 police received a report that Miller was moving marijuana plants from inside his residence to outside his residence. He was reportedly witnessed carrying the plants to an area behind two tents in his yard.
Officers responded to the residence. Miller took Police Chief Jeff Rhone to the back of the residence to show him that there was nothing there. Officer Vincent McGinnis arrived and followed Miller and Rhone. Upon reaching the rear of the home police observed a small marijuana plant on the deck by the back door. Officers then check near the tents and discovered five more marijuana plants. Miller then gave police consent to search the residence. Officers found a small cellophane cigarette wrapper in an upstairs bedroom. The wrapper had a very small amount of marijuana in it.
Police said that Miller denies growing the plants, and that he told them he found them while mowing and using his weed eater. He reportedly told them that he did not want to destroy the plants, only to hide them, and that he did move them. He told police that he found them along a wooden fence on the south side of the residence.
