CLEARFIELD – The head of a Clearfield County government department waived his right to a preliminary hearing on DUI charges.
Josh Quigley, director of the Clearfield County Emergency Management Agency, faces charges of DUI (incapable of safe driving); DUI (highest rate of alcohol); driving on right side of roadway; driving on roadways laned for traffic; careless driving; restrictions on alcoholic beverages; and failure to use safety belt system.
According to the affidavit of probable cause, on Oct. 31 a state trooper was on routine patrol at 2:40 a.m., westbound on state Route 879. The trooper noted that he observed a vehicle, a tan 2001 Chevrolet S-10 traveling east on SRT 879. As the truck traveled east the trooper reported that it crossed the double yellow line while in the area of Berndt’s Tobacco Outlet and partially into the lane of travel of the state trooper. The trooper then conducted a traffic stop.
The trooper identified the driver as Quigley and noticed that he was not wearing his seat belt. The trooper reported that as he spoke with Quigley he could detect an odor of alcohol coming from Quigley. He noted that Quigley’s eyes were reportedly glassy and that his speech was slurred. The trooper asked Quigley if he had been drinking alcohol earlier in the evening and Quigley reportedly said he had.
The trooper then asked Quigley to exit the vehicle and perform a field sobriety test, which he reportedly failed. The trooper reported that when Quigley left his vehicle he noticed an open bottle of beer in the center console of Quigley’s vehicle.
Quigley was taken to Clearfield Hospital for blood testing. According to the affidavit Quigley’s BAC came back with a result of 0.222 percent.
His hearing was scheduled for this Wednesday. Quigley was promoted to the director position in EMA in June 2007.
