DUBOIS – The Pennsylvania State Supreme Court has decided not to hear Sandy Township’s appeal of the verdict on who counts as a free holder in Treasure Lake, announced Sandy Township Solicitor Greg Kruk.
Kruk stated in the Sandy Township Supervisor’s meeting Monday night he had just received the letter earlier in the day notifying the township of the decision. The decision not to hear the appeal means the previous verdict in favor of Treasure Lake stands. The process that will determine if Treasure Lake can secede from Sandy Township will continue on to the next stage involving a Clearfield County committee investigating the scenario.
Sandy Township appeal was based on the definition of a free holder. Treasure Lake needed a set percentage of free holders, property owners who live in the community, to sign a petition before moving to this next step. Treasure Lake’s petition included enough signatures to meet this threshold if you counted individuals who owned homes in the community.
Sandy Township was arguing that time share owners and individuals who owned property in Cayman’s Landing, the camp ground area, should also be counted as free holders. This would have increased the number of required signatures above than the number of signatures were on the petition.
