CLEARFIELD – A Clearfield man has been accused of driving under the influence and also being in possession of drugs.
Robert Lee Miller Jr., 47, has been charged by Officer Daniel W. Podliski of the Clearfield Borough police with two felony counts of manufacture, delivery or possession with intent to manufacture or deliver and a felony count of dealing in proceeds of unlawful activities.
Miller has also been charged with a misdemeanor count of DUI/controlled substance and use/possession of drug paraphernalia; two misdemeanor counts of intentional possession of a controlled substance; and a summary.
On Wednesday Miller had all charges held to county court following a preliminary hearing during centralized court. His bail is set at $100,000.
According to the affidavit of probable cause, at 7:36 p.m. Sept. 18, 2017, Podliski was patrolling the area of Bridge and North Third streets. He observed a white Dodge truck parked at CVS Pharmacy.
Podliski was familiar with Miller and aware from previous incidents that he has a suspended license and frequently operates a vehicle. He saw Miller exit CVS and enter the driver’s seat of his truck; he backed up and drove toward the exit.
Podliski pulled onto Bridge Street and turned right onto Park Place. When Miller observed the police unit, he put his arm over his face to cover it as he passed by. Miller traveled across Park Place and through the Buck’s Pizza parking lot.
Miller attempted to exit the wrong way using the CBT Bank entrance off Bridge Street. Podliski activated his emergency lights and when he made contact with Miller, he was sweating profusely. Miller reportedly had bloodshot eyes and constricted pupils.
Miller was asked to exit his truck and then administered field sobriety tests after which he was taken into custody. Clearfield County Dispatch also advised that there were warrants for Miller through Centre County.
A search of Miller turned up a piece of a red straw in his wallet. He also had $4,511 in $100 bills, plus a $5 bill and some $1 bills.
During a search of his truck, a cigarette pack was located under the driver’s seat. Inside the pack was a baggie containing suspected methamphetamine; additionally inside the pack was a blue transparent bag containing a white powder.
A second cigarette pack was located on the seat. Two pieces of straws were inside, and both reportedly had residue. Inside the glove box, there were two glass pipes, which had a white residue.
Miller was asked to speak with a Pennsylvania State Police Drug Recognition Expert, which he agreed to. He was subsequently evaluated by a trooper who indicated he was under the influence of a controlled substance to a degree that it would have impaired his ability to operate a vehicle.
Miller was transported to the Clearfield Penn Highlands Hospital, where he refused to submit to a chemical test of blood. He was then transported to the police station and later released to a sober adult.
On Sept. 22, 2017, Podliski received the DRE report indicating Miller was under the influence of CNS stimulants.
On Dec. 14, 2017, a search warrant was executed on Miller’s phone by a DuBois City police officer. He provided Podliski with a CD containing extracted data from the phone.
On Jan. 30, 2018, a laboratory report showed Miller was in possession of a baggie of methamphetamine weighing 10.38 grams and Pentylone, a substituted Cathinone, weighing 1.2 grams.
Podliski reviewed the messages from Miller’s phone between the dates of Aug. 28 through Sept. 9 of 2017. Numerous messages allegedly indicated he was involved with the distribution of drugs, including methamphetamine, marijuana, Percocet and Pentylone.
