DUBOIS – Two brothers accused of participating in the Oct. 23 rape of a DuBois woman had joint preliminary hearings on Friday.
Brian Selvage, 21 of DuBois is charged with conspiracy to commit rape-forcible compulsion, indecent assault without the consent of other, indecent assault-forcible compulsion, indecent assault-threat of force, indecent assault-impaired compulsion, recklessly endangering another person, kidnapping and unlawful restraint.
Thomas Selvage, 22 of DuBois, is charged with conspiracy to commit rape, rape-forcible compulsion, rape-substantially impaired person, Idsi-forcible compulsion, Idsi-person substantially impaired, sexual assault, kidnapping and unlawful restraint.
The alleged victim in the case testified that on Oct. 23 around 8 p.m. she was at the Selvage residence with two other co-defendants in the case, Stephen Henry and Vincent Hart. She said she drank about seven beers. She said she went upstairs to use the bathroom and when she was ambushed.
“I got snatched,” said the woman.
She said that Henry held a knife to her and that she was duct taped then undressed. She said the others in the room were doing what Henry told them too.
She testified under direct examination that Henry and Hart and one other person out of the four had sex with her. She said she could not remember who and that after everything began she closed her eyes.
She testified that at one point she was raped by two of the men at the same time.
She said that earlier in the evening she was given Hawaiian Punch with beer in it. She said she was later told by Henry that the drink was drugged.
She testified the Henry ordered Brian Selvage to hold her at knife point while she was on a couch. She also testified that when the other men were done with her that Brian Selvage told her to kiss him, which she said she did.
Officer Randall Young of the DuBois City Police Department testified that he spoke with both Brian and Thomas Selvage. He said that Brian Selvage admitted to being at the scene at the time of the alleged incident. He said that Henry told him to walk her to the couch. Young said Brian Selvage told him he touched her breast and vagina and that he admitted to being present during the sexual assaults the woman was allegedly subjected too. Young said that Brian Selvage told him the woman was crying the whole time and that he also observed his brother Thomas Selvage having sex with the woman.
Young said Thomas Selvage told him he saw Henry grab her and that she was crying and nervous. He said Thomas Selvage told him he removed the woman’s underwear of his own accord and that he admitted to touching her vagina.
Young said Thomas Selvage admitted to having intercourse with the woman. He said Thomas Selvage told him he was given a condom, told how to use it and that he “did it.” Young said Thomas Selvage also admitted to helping Henry penetrate her.
Magisterial District Judge Patrick N. Ford held all charges to court.
Both men are currently incarcerated in Clearfield County Jail.
