DUBOIS – A DuBois man is accused of driving under the influence of alcohol or a controlled substance following a traffic accident.
According to an affidavit of probable cause filed with District Judge Patrick Ford’s office April 28, David A. Spuck, 61, 182 Spuck Rd., DuBois, is charged by the Sandy Township police with DUI, resisting arrest, careless driving, disorderly conduct and one summary traffic charge following a traffic accident April 19.
According to the affidavit, officers were called to a traffic accident on Hungry Hollow Road near Salada Road, where the vehicle was on its side and the driver was unable to get out.
As officers arrived, they saw the driver, later identified as Spuck, climbing through the driver’s side window, jumping off the truck and landing on the ground on his left side.
The officers attempted to assist Spuck, and told him to stay sitting on the ground until an ambulance arrived, but Spuck got to his feet, stumbled and fell back to the ground. He attempted to get up a second time, fell against his truck and then stumbled toward the patrol car.
The officers told Spuck to stay near the rear of the patrol vehicle, but Spuck appeared to be highly intoxicated, with blood-shot eyes and slurred speech. Spuck also allegedly argued with the officers and refused to listen to their commands.
The officers attempted to handcuff Spuck in order to secure him inside the vehicle, but he refused to comply and began to swear at the officers and allegedly began to flail his arms around.
The officers were able to subdue Spuck and placed him inside the vehicle. When the ambulance arrived, Spuck allegedly refused treatment.
Spuck was taken to Penn Highlands DuBois and allegedly consented to blood-alcohol testing; however, Spuck began to yell loudly at the phlebotomist.
A second phlebotomist was called to perform the blood-draw, but Spuck continued to act aggressively and the officers constituted Spuck’s actions as a refusal of the blood draw.
