CLEARFIELD – A DuBois man found guilty of selling drugs has been sentenced to state prison.
James E. Carter, 52, 302 Tozier Ave., DuBois, was found guilty of two counts of possession with intent to deliver a controlled substance, two counts of possession of a controlled substance and criminal use of communication facility after a trial in March. Judge Paul Cherry sentenced him to one to three years in state prison during plea and sentencing court in Clearfield County.
The charges stem from an incident in DuBois in September of 2013 when Carter sold Percocet and Ritalin pills to a confidential informant.
Prior to sentencing, Carter’s father addressed the court stating he needed him to help him care for his mother. Carter himself stated that he didn’t know “how this happened.”
Cherry commented that even though Carter was convicted of these charges, he shows no remorse and is still denying his guilt.
Carter was a former “Fugitive of the Week” because he failed to appear for criminal call in May of 2014. He was located in Bedford County in Tennessee and extradited to Clearfield in November, according to District Attorney William A. Shaw Jr.
During the trial, a confidential informant, who arranged the buy and actually exchanged money for the pills, testified that she decided to help local law enforcement after she was arrested because her boyfriend had marijuana. She has since been sentenced to probation.
She explained that she contacted Carter through a text message asking him if he had any “speed” or “killers” meaning pain killers. He responded, asking her if she had the money she owed him from a previous buy.
She told him she did and also asked if she could bring along a friend who wanted to get pills too. She arranged for the purchase of the pills. She, along with an undercover agent of the Attorney General’s office drove to Carter’s residence.
The informant testified that once upstairs in the home, she gave Carter $104 and he gave her three Percocet pills and two Ritalin pills.
After they traveled back to the police station for a debriefing, they realized they had over paid for the drugs. The informant owed Carter $30 from a previous purchase. The cost of the pills she was given during this buy was $44, leaving another $30.
She called Carter and he told her she could come back. They returned to his residence where Carter gave her two more Ritalin pills.
When asked if she was sure Carter was the one who sold her the pills, she agreed there was no doubt it was him.
The testimony of the agent and the other officers involved confirmed these events.
Carter was arrested as part of operation “Wrong Choice” in October of 2013.
