CLEARFIELD – The Clearfield County Commissioners approved retaining Rhoads & Simon LLP to assist Solicitor Kim Kesner in defense of the pending appeal filed against its 10-year Integrated Municipal Waste Services Plan.
Kesner said for the past one-and-a-half years, the county has been formulating its municipal waste plan, which was approved by the state’s Department of Environmental Protection (DEP) on Jan. 28. He said its approval was published in the Pennsylvania Bulletin on Feb. 16, and there was a 30-day appeal period from that date.
On the very last date, Kesner said that Waste Management, a disappointed proposer, filed an appeal. He said it’s an appeal with the Environmental Hearing Board, and those proceedings require specialized counsel. Kesner recommended that the county retain Attorney Paul J. Bruder Jr., who is a former attorney for the DEP and who has previously represented the county.
Although there is an existing appeal, Kesner said the municipal waste plan has been approved and the county is required to implement it. He said its plan provides for the disposal of Clearfield County wastes at two facilities, the Veolia Greentree and Wayne Township landfills.
He said that Clearfield County Solid Waste Authority Director Jodi Brennan has recommended the county send a letter to all of the haulers to confirm the effect of the plan and their obligations under the plan. He said it would also request the haulers’ assistance in helping the county identify any hauler that doesn’t dispose of waste properly.
Kesner said he had prepared a letter and sought authority to send it to the haulers. The commissioners approved of Kesner doing so.
