CLEARFIELD – A Brisbin man convicted of aggravated assault and conspiracy was sentenced to state prison Tuesday during sentencing court.
Cody Lynn Luzier, 37, was sentenced by President Judge Fredric J. Ammerman to serve 51 months to 8.5 years in state prison.
After his trial in May, the jury chose to acquit him of the additional charges of robbery, criminal conspiracy/robbery, a second count of aggravated assault, criminal conspiracy/aggravated assault and strangulation.
The original charges stem from an incident on Nov. 20 at a Brisbin residence.
In a second case, Luzier pleaded guilty to contraband/controlled substance for which he was given an additional state prison term of nine months to three years. In this case, he was found in possession of methamphetamine when he was transported to the county jail.
According to the affidavit of probable cause, on Nov. 20 the victim contacted Kacy Rae Figart, 31, asking about the two getting together. She invited him to her home to visit with her and another female friend.
The victim arrived at the home around 2 a.m. that night. They were in the living room for a while before Figart asked him to go back to the bedroom to look at her water bong, police said.
As he walked back toward the bedroom, he was reportedly attacked by Luzier, who struck him in the head multiple times with a metal object.
The victim told authorities he fell to the floor and Luzier jumped on top of him. Luzier then began to choke and threatened to kill him, according to the criminal complaint.
Somehow the victim was able to get away from Luzier and leave the residence. He sought treatment at Penn Highlands Clearfield, according to the police report.
Luzier was accussed of taking $415 and a Bluetooth speaker from the man.
During the trial, Luzier testified in his defense, saying he did not rob the victim, but admitted to getting angry and fighting with him, according to media reports.
Figart, whose address is now listed as Curwensville, is facing similar charges. Her case is still pending.
