DUBOIS – A DuBois man accused of possessing over 11 grams of methamphetamine waived his right to a preliminary hearing Friday during centralized court.
Douglas C. Bundy, 49, was charged in December with felony manufacture/delivery/possession with intent to deliver a controlled substance, misdemeanor intentional possession of a controlled substance and possession of drug paraphernalia by DuBois City police in relation to an encounter with him on Sept. 6, 2018.
According to the affidavit of probable cause, police saw Bundy operating an ATV in an alley way even though he had been told previously not to do this. After he saw the officers, he pulled the ATV into a yard.
While police spoke with him, they noted he was very nervous and pacing back and forth as he was sweating profusely.
He was asked if he had any weapons and he admitted he had a knife in one of his bags. An officer who searched it found the knife and numerous tree cameras.
After he was asked if there was anything else the officers needed to know about, he consented to a search of the bags in the back of the vehicle. Nothing was found but there was an additional bag in the front.
At this point, Bundy allegedly became more nervous as they focused on this bag. Because he seemed to not want them to search it, they discussed calling for a canine officer.
One of the officers went back to the patrol car. When Bundy asked what he was doing and was told he was calling for a drug dog, Bundy “sighed and said, ‘there is meth in the bag’.”
Bundy opened the backpack and then a green tool box. In this box was a glass pipe, bowls for smoking marijuana, drug packaging materials and $113 in cash.
Out of a cigarette pack he pulled out a plastic bag containing a small amount of crystal methamphetamine. He then crumpled up the box and threw it back into the tool box. One of the officers picked the cigarette box up and found a large amount of methamphetamine that Bundy then claimed he did not know was there.
A further search uncovered a small amount of marijuana and additional paraphernalia.
Once they were back at the station, Bundy admitted to selling methamphetamine, according to the report.
Bundy was convicted for selling methamphetamine in a similar case after a trial in June of 2019.
According to a previous GANT article on that case, in June of 2018, Bundy was found by DuBois City police, as he was riding an ATV on railroad tracks. He had several bags, one that had crystal methamphetamine weighing 7.8 grams.
In October he was sentenced to serve one to two years state prison and was ordered to report on Oct. 28 to begin his sentence.
After he failed to report as ordered, he was charged with escape and default in required appearance. In December he withdrew a guilty plea in that case.
