DUBOIS – A DuBois man accused of threatening an employee who wouldn’t sell him cigarettes waived his right to a preliminary hearing Friday during centralized court.
David M. Stonebraker, 36, was charged with terroristic threats and disorderly conduct by Sandy Township police after an encounter with them June 4. His bail was lowered from $10,000, monetary to $10,000, unsecured at the time of the hearing.
According to the affidavit of probable cause, the police responded to the Dollar General Store on Brady Street for a report of a man threatening and swearing at an employee.
This employee told the officers the man, described as six feet tall with long, curly hair and a heavy build, came into the store to purchase cigarettes.
When he was asked for identification, he said he did not have his ID on him. The employee then refused to sell him the cigarettes. The man became irate, and yelled at her.
He then threatened that he was going to get a gun and shoot her, she told police. He left the store and walked across the parking lot towards town on Brady Street.
The officers were able to watch the surveillance video and see the incident. When they left the store, they traveled north on Brady Street where they saw the suspect walking toward the bridge. They continued over the bridge where they turned around and waited for him.
As he approached, they asked him to come over to the police car. He ignored them, police said. When they walked up to him he asked what they wanted in an agitated tone. He then stopped and faced them.
He was asked for his name, but he allegedly said he didn’t have to give them his name. He said it was a free country and the police were communist.
He became more agitated when speaking to them and put his hands in his pockets. One of the officers asked him to keep his hands out of his pockets, but he didn’t listen, according to police.
When the officer asked again, he swore at him. At this point, the officers grabbed his hands as they were still in his pockets. He allegedly turned and attempted to pull away from them. He was then forced against the car and placed into handcuffs without further resistance.
The suspect did have a wallet with an ID card identifying him as Stonebraker. After he was placed into the patrol car, he allegedly became more agitated and threatened to kick the officer’s [expletive].
Stonebraker said the police were born from Hitler and that people were out to get him because his grandfather was in World War II, according to the report.
