CLEARFIELD – The Clearfield County Commissioners proceeded with preparations for the county’s annual upset tax sales at Tuesday’s regular board meeting.
First, the commissioners approved a resolution to appoint 11 individual contractors for posting and personal service for the 2017 upset tax sale.
Second, the commissioners approved the purchase of service agreements for the posting and personal services by those individuals.
Prior to the board’s vote, Solicitor Kim Kesner explained that real estate tax law has mandatory requirements that must be satisfied before annual tax sales.
According to him, one requirement is that each property, which is scheduled for sale, must be posted at least 10 days prior to the sale.
He said with regard to owner-occupied property, a sale cannot occur unless there has been personal service of the owners. Law provides this service be done by the sheriff.
However, Kesner said the commissioners have the ability to enact a resolution to appoint others to conduct the personal services.
In past years, he said the commissioners have engaged independent contractors for the purposes of posting and personal services, and the county’s Tax Claim Bureau has prepared that list for 2017.
Commissioner Mark B. McCracken explained that there aren’t any issues with the Sheriff’s Office. He said the office is tied up handling its daily duties.
