HARRISBURG – Legislation authored by state Rep. Tommy Sankey (R-Clearfield/Cambria) that saves money and reduces “red tape” for Pennsylvania’s more than 400 scrap metal processors has been signed into law by Gov. Tom Wolf.
“As a member of a third-generation family business, I’m aware of the bureaucracy our small businesses have to wade through on a regular basis,” Sankey said. “This bill will impact a relatively small number of Pennsylvanians, but it is the kind of legislation that helps to maintain local family-sustaining jobs and local economies.”
Prior to Act 91 of 2016 (formerly House Bill 871), scrap metal processors had to have appropriate paperwork notarized and verified when non-repairable vehicles were turned over to them. This legislation aligns them with salvage dealers, who do not face similar requirements.
“Allowing scrap metal processors to operate under the same set of rules as their competitors levels the playing field, in addition to saving time and money,” added Sankey. “The notary and verification costs for one vehicle may not be great, but multiply it by the amount of business done. With a small business, every little bit counts.”
Sankey says his bill is also consumer friendly because the additional costs are often passed on to the individual looking to get rid of the vehicle, which may dissuade them from considering a scrap metal processor.
In addition, the legislation includes provisions which reduce fraud and vehicle theft. Lastly, it includes a process for an insurer, following a total loss, to obtain a salvage certificate from PennDOT after they have agreed to a settlement with the owner of the vehicle if they haven’t obtained the endorsed title from the owner within 30 days.
