CLEARFIELD – A Clearfield man accused of raping an 11-year-old girl was sentenced to state prison Wednesday in Clearfield County Court.
Kyle Andrew Wilson, 22, an inmate of state prison, pleaded guilty before President Judge Fredric J. Ammerman to rape of a child, aggravated indecent assault, statutory sexual assault, aggravated indecent assault person less than 13 years of age and indecent assault person less than 13 years of age.
Ammerman sentenced him to a total of seven to 14 years in state prison. This sentence will run consecutive to a sentence he received in November of 2014 of 18 months to six years for statutory sexual assault, a probation revocation sentence of six months to two years and a sentence for false alarm to agency of public safety of 90 days to three years.
He will serve a total term of nine years and three months to 25 years in state prison.
Wilson was determined by an expert to be a sexually violent predator, and he will have to register his address with law enforcement for the rest of his life. When he pleaded guilty in his other sexual assault case, he was also found to be a sexual predator. In that case, he was accused of having sex with a 14-year-old girl.
Prior to sentencing District Attorney William A. Shaw Jr. explained that the assault in the latest case occurred when Wilson was 17 years old and the victim was only 11 years old in March of 2011.
Shaw asked the judge to consider the danger component in this case because he is concerned about what Wilson will do when gets out and is around another young female.
Wilson’s attorney, Curtis Irwin, asked the judge to give Wilson a concurrent sentence because “he will continue to be incarcerated for a significant period of time.”
This case took place prior to his other cases, and Irwin stated that if the charges had been filed earlier, he would have tried to consolidate the charges into one plea agreement.
Wilson’s mother addressed the court, saying “Kyle is not as bad as you think he is.” She stated that there is nothing to prove this incident happened and questioned why it wasn’t brought up earlier. She was clearly upset and said she did not have the money to hire a lawyer who could have taken the case to trial.
Ammerman assured her that Irwin, who is with the Public Defender’s office, is a good attorney, adding that handling criminal cases is all he does. He reminded her that this is what Wilson agreed to do.
The victim’s mother who said earlier that she did not wish to speak then addressed the court, explaining her daughter was traumatized by the event.
“It took a long time for her to talk about it,” she said, adding that she was proud of her for speaking up. She said her daughter still has nightmares.
The victim’s mother stated that she has forgiven Wilson and prays for him. She commented that she hopes he can do something with his life.
Ammerman stated that he didn’t know if he would feel the same way if he were in her situation.
According to the affidavit in the latest case, the victim said she was walking from the Clearfield Area Middle School with a friend and an older boy named Kyle. The friend left and the victim asked Wilson to stay with her until her father came to pick her up. Wilson asked her if she wanted to smoke marijuana and she said yes. They continued walking to a wooded area near Penelec along Arnold Avenue where no houses were visible.
He allegedly tripped the victim, causing her to fall to the ground. He put his hand over her mouth and told her no one would be able to hear her. She hit him on the shoulder and told him to stop as he raped her.
Afterwards she waited until he walked far enough away before getting up. She cried and then called her father who picked her up at a business along Park Avenue. Her father asked what was wrong, but she told him she was fine.
The victim didn’t tell anyone until she spoke with a therapist.
Officers took her to the area of the incident to determine whether the assault occurred in Clearfield Borough or Lawrence Township. She became upset but was able to pinpoint the location of the assault.
She was able to identify Wilson from a photo line up of suspects.
When questioned about this assault, Wilson claimed the sex was consensual. He also asked investigators “how long am I going to get for this one?”
According to the criminal complaint in the other sexual assault case, the 14-year-old victim told police that she received a text from Wilson, who was asking her to hang out with him. She got permission to leave her residence to meet with Wilson. She and Wilson walked to his grandfather’s residence where he asked her to go into a camper trailer on the property. It was there that he raped her.
She later admitted to police they had been talking about having sex. That evening when they were in the camper, he asked if she wanted to have sex. She said no. He said if she didn’t, he would hurt her or tell his girlfriend she had sex with him. She stated she got scared and agreed so he wouldn’t hurt her.
She told her mother what happened when she got home and the mother called police.
