DUBOIS – A DuBois man who threatened to shoot a woman and her children is now facing charges.
Joseph Francis Alvin, 31, 135 E. Weber Ave., DuBois, has been charged by DuBois City police with terroristic threats, simple assault, harassment and driving while operating privilege is suspended or revoked. The charges stem from an incident on Nov. 18 at Alvin’s residence.
According to the affidavit of probable cause, police were called to the home at 8:26 p.m. The victim said Alvin was screaming at her and threatening to harm her and her children. She explained that he had been sent to a mental health facility the previous week for threatening to shoot her.
Before they arrived, police were advised that he left the residence in a gold Nissan Altima. Then he returned, and left again as an officer appeared on the scene. Another officer in a vehicle got behind Alvin’s vehicle, activated his emergency lights and followed Alvin’s vehicle, as he made a circle around the block and back to the residence.
The officers made contact with him, asking what was going on. He said he and the victim got into an argument so he left the residence. He came back because he saw police were there.
The victim told police that earlier that day she discovered Alvin was abusing his medications. She then told him she wanted him out of the house and he said he was going to move out.
Later when she arrived home from work, he was still there and sleeping. When he woke up he told her if she died, he would kick her in the face. He started yelling at her asking if she was going to “302 him again or call the cops.” He stated that just because she didn’t find a gun didn’t mean he did not have one. She asked him if he had a gun and he laughed at her.
She told her children to get their things together because they were leaving for the night. As she was putting her shoes on, he approached her in an aggressive manner. She sat back because she thought he was going to hit her. Alvin got right in her face and said “[Expletive], I hate you, and I will shoot you in the face. Don’t think I won’t.”
She then got off the couch and started to call 911. As she did this, he told her to call the cops because he would shoot them, too. Before he left the home, he pointed his finger at her like a gun and said “bang, bang, your kids are dead.”
While she waited for police, she said he came back around the block, got out of his car and started screaming, that she was “done.” He then got into the trunk of his car and started running towards the door. She went inside the home and locked the door as she waited for police.
According to online court documents, Alvin was charged with disorderly conduct after an incident at his residence on Nov. 7 when he was allegedly confrontational with officers and was ordered to stop causing a disturbance. However, he allegedly went back outside and began using profanity and yelling again, according to a police report.
