CLEARFIELD – A Clearfield man charged with selling synthetic marijuana was sentenced in Clearfield County Court.
Scott Allen Hockenberry, 37, 993 Park Ave., Clearfield, pleaded guilty to criminal conspiracy, manufacture/delivery/possession with intent to deliver a controlled substance and possession of drug paraphernalia.
He was sentenced by Judge Paul E. Cherry to 90 days to one year in jail and two years consecutive probation. He was fined $600 plus costs. He must complete drug and alcohol counseling.
This sentence will run consecutive to a sentence for retail theft for 90 days to one year that he received in November.
According to the affidavit of probable cause, police received information about the sale of synthetic marijuana from a Park Avenue residence. Hockenberry and Amber Dick had purchased synthetic marijuana from the Internet that was shipped through United Parcel Service to their home address.
UPS released information that between August and December of 2013, 27 parcels were sent from MagicMans Wholesale in Bakersfield, Calif., to them. This shop was known to sell various items, including smoking pipes and incense that is commonly found to be synthetic marijuana.
On Dec. 17, 2013, a parcel addressed to Amber Dick was intercepted at the UPS hub in State College. A search warrant was obtained and the parcel was opened. It contained 10 packets of synthetic marijuana labeled “Mind Trip” weighing 10 grams each.
The package was taken to the Park Avenue address where police made contact with Hockenberry. He agreed to talk about the parcel and invited them into the residence. Amber Dick was also present.
Both admitted to having knowledge of the contents of the package that they ordered online and to smoking the substance. The couple agreed to a search of the apartment. Police found digital scales, plastic baggies, glass smoking pipes, an “owe sheet” and another empty package from MagicMans addressed to Amber Dick.
A lab test of the substance confirmed that it was a schedule 1 controlled substance.
