CLEARFIELD – A Clearfield man accused of sexually assaulting a young teen was sentenced after a Megan’s Law assessment hearing.
Kyle Andrew Wilson, 20, 517 Bigler Ave., Clearfield, pleaded guilty to statutory sexual assault and indecent assault of person less than 16 years old.
He was sentenced by President Judge Fredric J. Ammerman to 18 months to six years in state prison. He must complete sex offender counseling and he is not permitted to have contact with any females under the age of 16.
The new sentence will run consecutive to a probation violation sentence of six months to two years in state prison that he received in July.
After listening to testimony from an expert, Ammerman concluded that Wilson is a sexually violent predator. Wilson will have to register his address with law enforcement for the rest of his life.
Prior to sentencing, testimony from the expert indicated that Wilson was likely to be a repeat offender. District Attorney William A. Shaw Jr. pointed out that Wilson had a case as a juvenile, which was similar to this one.
Wilson’s mother addressed the court explaining that he has some mental problems and when he is off his mediation, he can be “talked into anything.” She questioned whether he really understood the charges and she felt he should have a trial rather than plead guilty.
Wilson’s attorney, Curtis Irwin, also said Wilson has both attention deficit hyperactivity disorder and a personality disorder. He stated he had presented the options to Wilson before he decided to plead guilty.
When asked if he wanted to proceed with sentencing, Wilson replied that he didn’t know. Ammerman said Wilson had signed all the forms and he decided to sentence him on the charges in accordance with the plea agreement.
According to the affidavit of probable cause, police received a report May 28 that a 14-year-old girl had been sexually assaulted by Wilson. The girl was transported to Penn Highlands Clearfield to have a rape kit done. Officers found Wilson and questioned him about the assault. He denied having sex with her.
The victim told police that she received a text at 6:20 p.m. from Wilson, who was asking her to hang out with him. Officers were able to verify the message on her phone. She got permission to leave her residence to meet with Wilson.
She and Wilson walked to his grandfather’s residence where he asked her to go into a camper trailer on the property. Once inside her story was that he pushed her back to the bedroom and forced her down onto a bed. He then removed her clothing and forced himself on her. He only stopped when he was startled by his grandfather, she said.
She told her mother what happened when she got home and the mother called police.
In his interview with police after he was in custody, Wilson claimed she cornered him in the trailer and pushed him onto the bed where she pulled down his pants. He said he told her to stop and tried to get away from her. After about five minutes, he said she got off of him.
On June 5, Wilson was questioned again. This time he admitted to having consensual sex with the girl. He said he posted “I need laid” on his Facebook page and the victim responded to this with “I’ll do it.”
A few days later, he sent a text message to her asking her to go to his grandfather’s house to help move clothes. Once in the camper, she asked if he wanted to have sex, he said. They then went to the bedroom where they had intercourse.
The victim was interviewed again on June 17. This time she admitted they had been talking about having sex. That evening when they were in the camper, he asked if she wanted to have sex. She said no. He said if she didn’t, he would hurt her or tell his girlfriend she had sex with him. She stated she got scared and agreed so he wouldn’t hurt her.
