DUBOIS – A Millerton man has been charged with a drug delivery resulting in death, announced Clearfield County District Attorney William A. Shaw Jr. today.
Shaw identified the defendant as Ryan Seth Ray, 24, of Pine Hill Drive, Millerton. Sergeant Rodney Fairman of the Sandy Township Police Department filed the criminal complaint. Ray has been charged with drug delivery resulting in death, involuntary manslaughter, possession of a controlled substance and possession of drug paraphernalia.
According to the affidavit of probable cause, on July 26, the Sandy Township police were dispatched to a hotel on Rich Highway to assist emergency personnel with an unresponsive male. Upon arrival at the scene, police entered a hotel room and observed emergency personnel performing a CPR chest compression on a male who was lying on the bed.
Emergency personnel advised police that they believed it was a possible drug overdose. Police were then informed that the victim had died. Upon investigation it was found that Ray had provided the victim with a bag of heroin, and the victim had injected himself with it. Police located both used and unused needles at the scene.
Ray was arraigned today before Magisterial District Judge Jerome M. Nevling with his bail being set at $50,000. A preliminary hearing is scheduled for Nov. 1. Ray is currently incarcerated in the Clearfield County Jail.
Shaw stated that he was pleased with the investigative efforts of the Sandy Township Police Department in this case. He stated that until recently, the drug delivery resulting in death statute had been ruled unconstitutional by the Pennsylvania Appellate Court. The law, Shaw stated, has now been amended to satisfy constitutional scrutiny and they intend to pursue these types of cases.
