CLEARFIELD – A Clearfield man who was accused after a drug raid that occurred at his camp in May of 2012 waived his right to a preliminary hearing during Centralized Court Wednesday at the Clearfield County Jail.
Clint Robert Horm, 41, of Clearfield is facing charges of criminal conspiracy; manufacture/deliver/possession with intent to manufacture or deliver controlled substance; intentional possession of controlled substance by person not registered; and possession of drug paraphernalia.
According to the affidavit of probable cause, at approximately 1:27 a.m. May 2, 2012, Trooper Michael Berta of the Clearfield-based state police contacted Trooper Jared K. Thomas of the Troop C Vice Unit. Thomas is stationed at the Punxsutawney-based state police and works undercover investigating violations of the state’s Controlled Substance, Drug, Device and Cosmetic Act.
Berta advised Thomas he had received information that a vehicle was expected to deliver cocaine to Horm’s camp located on Progress Camp Road in Goshen Township. Berta had observed someone pull out of Progress Camp Road and stopped them for traffic violations. Operator Joshua Lee Moser related he had been at the camp owned “by a guy named ‘Clint,’” who was attempting to sell him methamphetamine. Moser also related he’d left approximately three-fourths of an ounce of powder cocaine at “Clint’s” camp. Berta gained consent to search the vehicle at which point he discovered approximately one ounce of powder cocaine. Moser provided a written statement to state police that he’d arrived at Horm’s camp at around 10 p.m. and Horm wanted him to purchase methamphetamine.
On May 2, 2012, Thomas applied for and obtained a search warrant from Magisterial District Judge Jerome Nevling. At approximately 11:40 a.m., Troop C Vice Unit members and Troopers Terry Jordan and Mark McGinnis and Corporal Brett Hanlon executed the search warrant at Horm’s camp. Horm was located inside the camp with Kristin Lee McBride, 30, of Clearfield.
State police found on Horm: a Verizon LG cellular phone; a roll of U.S. Currency in his pocket that totaled $1,100; and $145 in U.S. Currency in his wallet. State police also seized the following items from inside the camp: a small plastic baggie that contained 3.1 grams of marijuana; Poly Technologies 7.52X39 AK47 with five rounds in the magazine; and three, different orange pill containers with various pills. Four, live marijuana plants were located outside the camp in a bucket in the yard.
At the camp, a blue-colored 2001 Ford Mustang was parked in the driveway. State police discovered a glass marijuana smoking device inside the glove box. State police discovered the following items inside a sweatshirt: a metal marijuana grinder; a U.S. Magnum digital scale; a blue-colored plastic container with mushrooms; a small, plastic baggie with suspected marijuana; and ZigZag rolling papers.
State police located a black Swiss briefcase inside the spare tire compartment of the trunk. The following items were discovered inside the briefcase: a plastic baggie with 20.2 grams of methamphetamine; a plastic baggie with .21 grams of Piperazine; a plastic baggie with 1.5 grams of sodium bicarbonate and a residue of cocaine; a cigarette wrapper with .19 grams of hashish; a multi-colored tin with paraphernalia; two digital scales; a switchblade knife; a silver spoon with residue on it; batteries for the digital scales; an empty Marlboro cigarette pack; and two syringes.
On May 2, 2012, Horm was interviewed at the Clearfield-based state police barracks. He told state police that he had run into Moser at Sheetz. Moser needed a place to stay that night. Horm had previously met Moser through mutual friends. Moser went to Horm’s camp and gave Horm some cocaine. Horm told police that Moser had approximately an ounce of cocaine when he arrived at the camp. Horm admitted that he “did a line or two of coke throughout the night.”
The seized items were transported to the Clearfield-based state police and entered into evidence. The U.S. Currency from Horm’s pocket and wallet and from McBride’s bra was kept separate from each other, as well as separate from the narcotics.
On May 3, 2012, state police requested forensic analysis and items one through six were sent to the Erie Regional Laboratory. On May 4, 2012, the evidence was sent to the Erie Regional Laboratory. On Aug. 22, 2012, the Laboratory System Quality Specialist tested and weighed the methamphetamine; Piperazine; cocaine; psilocin; and marijuana.
In her case last month, McBride pleaded guilty to false identification to law enforcement officer. According to the affidavit of probable cause, on May 2, 2012, McBride identified herself as Christina Lynn Rainwater, 30, of Chicago, IL. She told state police she had just arrived in Clearfield the day before via the Fullington Bus Co. She was then transported to the Clearfield-based state police barracks to be fingerprinted and identified. At that point, she told state police that she was actually Kristin Lee McBride and on probation in Clearfield County.
