CLEARFIELD – A Curwensville man accused of breaking into a skating rink is going to be spending more time in state prison.
Nicholas Kyle Rumsey, 21, an inmate of state prison, pleaded guilty Monday in Clearfield County Court to burglary, possessing instruments of crime, and criminal mischief. He was sentenced to six months to two years in state prison. This sentence will run consecutive to his current sentence for probation violations. He was fined $3 plus costs and must pay restitution of over $2,290.
In a second case, he pleaded guilty to prohibited offensive weapon, simple assault and disorderly conduct. He received another consecutive sentence of six months to two years for this case. He was fined $3 plus costs.
Prior to sentencing, President Judge Fredric J. Ammerman stated that he doesn’t “enjoy sending people to state prison”, but looking back, Rumsey has an extensive juvenile record.
“Maybe we failed,” he said. “I just don’t have an answer”. He referred to the numerous lectures he had given Rumsey over the years and the different programs he had been involved in.
“I’m sorry to see it turn out like this for you,” he said adding that he hoped when Rumsey is released from prison things will be different.
According to the affidavit of probable cause in burglary case, on March 21 Lawrence Township Police received a call from the Skate Station regarding a break in. The actors entered through a rear door by kicking it in and then removed a cash register, two bank bags with approximately $550 in cash and change. They also took $900 from a change machine. They smashed a surveillance camera and attempted to make off with a computer DVD receiver, but left it behind. The total loss was estimated at $5,400.
The second actor, Shai Austin Delgrosso, 18, also faces charges of burglary, criminal trespass, theft by unlawful taking, receiving stolen property, possessing instruments of crime, disorderly conduct and criminal mischief.
