CLEARFIELD-A Clearfield man charged with rape pleaded guilty to lesser charges Tuesday in Clearfield County Court.
Shawn Andrew Hall, 21, Clearfield, was originally charged with rape, sexual assault, two counts of aggravated indecent assault, and two counts of indecent assault. Tuesday he pleaded guilty to misdemeanor charges of criminal coercion and simple assault. He was sentenced to 30 days to one year in jail and two years consecutive probation. He was fined $500 plus costs. He must also complete anger management counseling and 50 hours of community service.
The charges stem from an incident in Clearfield on April 16, 2010. According to the affidavit of probable cause, the victim asked Hall for a ride to her boyfriend’s house. Because he did not have a valid driver’s license, Hall asked another friend to drive him to pick her up. They then took her to Hall’s home. After the friend went to the garage Hall and the victim sat on the couch and watched television.
As they sat on the couch, he kept moving closer and touching her. When he tried to kiss her, she said she moved her head away and told him “no”. He continued to make advances to her, but during all of this, she told him no.
After she told him “no” she didn’t want to go upstairs, he carried her to an upstairs bedroom. On the way, she told him to put her down, but he didn’t listen, she told police. He pushed her onto the bed before getting on top of her. She continued to resist as he proceeded to rape her.
After this, she got out of the room and ran to the garage where the other friend was located. She asked him to take her to her boyfriend’s home. Hall also went with them and tried to talk to her about what happened. She refused to talk to him but he then texted her “why didn’t you just slap me or something. I honestly would of stopped. I honestly thought you were just messing around.”
In his interview with police, Hall stated as they watched TV they played around a bit, tickling each other. When he suggested they go upstairs he claimed she did not say no. He also stated he only carried her a short way up the stairs before he put her down and she walked with him to the bedroom. He denied having intercourse with her claiming she got upset after a few minutes of dry humping.
DNA evidence taken from the victim’s underwear matched Hall’s DNA.
