Two police officers went to the scene and talked to the alleged victim. The alleged victim told police that Church was in his (Church’s) apartment with the main door open and that Church was dressed in women’s clothing. He told police that church was masturbating in view of the common hallway. He also told police that Church had put a written not on his door asking him to join, as well as other sexually-related comments.
The officers went to Church’s apartment to speak with him. According to the affidavit, Church’s door was open and he was standing in plain view pleasuring himself into a clear plastic bottle, with pornography playing on the television. Church was reportedly dressed in women’s undergarments and wore makeup. Police noted that Church’s actions, and the pornography, were in plain view from the hallway.
