DUBOIS – DuBois City Solicitor Toni Cherry responded to the Flood Plain Ordinance from FEMA at Monday night’s city council meeting.
Cherry said after reading the ordinance she found it to be “an all encompassing ordinance.”
Cherry said she planned to prepare a draft of the ordinance to present to the planning commission for their Aug. 3 meeting. She said they would have to figure out how they would delineate the smaller areas within the larger one. “They would have to be isolated as particular flood zone areas,” Cherry said.
Cherry also said that council would have to discuss who would be the enforcer of the ordinance, whether it be the zoning officer or the city manager. She said it would be proposed to planning, who would make their recommendation to council.
Scott Farrell, the city’s engineer, said that any changes would have to go back to FEMA before council can vote on them.
Cherry explained to council that the ordinance is very advanced and even states that manufactured homes cannot be placed in a flood zone. She also said that she would choose the option she thought would be the best and then present that to the planning commission.
Farrell said that if she was just choosing an option, and not making changes, they would not have to submit anything to FEMA.
