DUBOIS – A 39-year-old Bradford man who has been accused of aggravated assault by vehicle while under the influence of alcohol waived his right to a preliminary hearing Friday.
Jeremy Miller, 39, of Bradford faces charges of aggravated assault by vehicle while DUI, two counts of DUI, driving on the right side of a roadway, not driving at a safe speed, careless driving resulting in serious bodily injury and restraint system.
According to the affidavit of probable cause, the DuBois-based State Police arrived at the accident scene at 8:37 p.m. on Aug. 8. They said Miller had been driving with two passengers – both family members.
Police said Miller was observed speeding on state Route 153 at which time it reached a curve in the wet roadway. They said he subsequently lost control of his vehicle, departed the roadway and struck a tree.
Police indicated that the vehicle’s three occupants were already removed from the scene for medical purposes at their arrival. They made contact with a nearby resident as a result.
The resident told police that she had heard the accident and went to the scene to offer assistance.
She notified police that one passenger who was a juvenile had been ejected from the vehicle. She told police that this passenger was located underneath the vehicle at her arrival, according to the affidavit of probable cause. She also stated she could smell alcohol on Miller.
Police stated that the juvenile had been to be airlifted to the Children’s Hospital in Pittsburgh. They said Miller and the other passenger had been transported to the DuBois Regional Medical Center and then to the Altoona Hospital.
Police were dispatched to collect information from both Miller and his second passenger. They indicated that when they made contact with Miller, he smelled of alcohol and. At 10:40 p.m., they had two vials of blood taken for testing with Miller’s consent. The results returned on Aug. 22 and showed Miller had a blood alcohol content level of .193%.
Miller’s juvenile passenger suffered both a broken leg and ankle as well as had three cracked ribs as a result of the accident. His second passenger had a fractured jaw, broken ribs, femur and leg while also suffering numerous cuts and abrasions. No injuries were listed for Miller.
