OSCEOLA MILLS – Decatur Township Police have been receiving an over-abundance of complaints about ATVs running rampant in the area of Decatur Township, Osceola Mills Borough and Houtzdale Borough.
The Decatur Township Police Department would like to remind the residents of Decatur Township and Osceola Mills and Houtzdale Boroughs that it is against the law to drive any ATV on the roadway, private property or a private road or driveway without expressed or implied permission from the landowner.
A roadway is considered a portion of a highway improved, designed or ordinarily used for vehicular travel, exclusive of the sidewalk, berm or shoulder eve through such sidewalk, berm or shoulder is used by pedalcycles. In the event a highway includes two or more separate roadways, the term roadways refers to each roadway separately but not all such roadways collectively or any part of the road owned by the state, township or borough.
A highway is the entire width between boundary lines of every way publicly maintained when any part thereof is open to use for purposes of vehicular travel. The term includes a roadway open to use of the public for vehicular travel on grounds of a college or university or public or private school or public or historical park.
A private road or roadway is a way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner, but not any other person.
Anyone found traveling on any state roads, township roads, borough roads, private roads or driveways and private property on an ATV will be cited on the spot. The DTPD would like people to consider this their warning.
