CLEARFIELD – A Clearfield man accused of aggravated assault while driving under the influence waived his right to a preliminary hearing on Wednesday.
Jeffrey Rexford Powell is charged with DUI (Bac .10 percent-to-.16 percent); DUI (highest rate of alcohol); five counts of aggravated assault by vehicle and related charges.
According to court records on March 21 police were called to an accident on Washington Avenue. Officers made contact with the people involved in the accident. Powell was driving a truck while the alleged victim in the case was driving a Hyundai. Three children in the car suffered injuries. The woman and a fourth child suffered abrassions. Police spoke with Powell, and asked for his license, insurance and registration. To get to the information police had to climb through the window of the truck to get the records.
Officers asked Powell if he needed treatment, and he reportedly refused. He was asked if he had been drinking and allegedly said “moderately.” It was at this time that they detected alcohol on his breath.
Records indicated that Powell failed three field sobriety tests and was arrested for suspicion of DUI. He was then taken for blood testing.
The woman and her passengers all suffered injuries as a result of the accident.
