CLEARFIELD – A Curwensville man waived his right to a preliminary hearing on an aggravated indecent assault charge.
David Allen Swatsworth is accused of aggravated indecent assault of a child, two counts of aggravated indecent assault, three counts of indecent assault and criminal attempt to commit the aggravated indecent assault of a child.
According to court records Swatsworth was staying at an acquaintance’s home when the acquaintance’s 11-year-old child awoke to find Swatsworth in bed with her. She told her mother and police that two years ago Swatsworth had hand one under her shirt and another in her pants. The girl said she was scared so she went back to sleep.
The girl told police that she was initially afraid to tell her mother because she was afraid her mother would not believe her. She also stated that Swatsworth slept in her bed several times before, but that she was unsure if he touched her.
The affidavit states that Swatsworth initially denied the incident when questioned by Clearfield Borough Police. He stated that he stayed at the residence when he was intoxicated and that it was possible he could have been in her bed due to the fact that he sleep walks. He stated however that he did not touch her as he would not touch a young girl.
When questioned by state police Swatsworth admitted to touching the girl. He stated that he remembered being in bed with her and putting his arm around her and fondling her.
Swatsworth is currently free on bail.
