CLEARFIELD – A 22-year-old Morrisdale man who was allegedly found in possession of drugs waived his right to a preliminary hearing Wednesday during Centralized Court at the Clearfield County Jail.
Garrett S. Emigh, 22, of Morrisdale has been charged with manufacture, delivery or possession with intent to manufacture or deliver; use/possession of drug paraphernalia; delivery/intent to deliver drug paraphernalia; and selling non-controlled substances similar to controlled substances.
The charges stem from an alleged incident Jan. 6 when state police at Clearfield were dispatched to assist Clearfield County Probation at 200 Wallaceton Rd., Morrisdale. Probation officers had responded to investigate a violation involving Emigh, and numerous contraband items, paraphernalia and cash were allegedly found in his possession.
According to the affidavit of probable cause, state police interviewed probation officers who located Emigh passed out in his bedroom. Upon waking and speaking with him, they allegedly observed a small portable safe at his bedside. Probation officers opened the safe and allegedly located numerous packages of a potpourri substance labeled as “Bizarro” and “Get Real,” a sandwich-sized plastic bag of suspected marijuana, drug paraphernalia, a digital scale and $739 in cash.
State police interviewed Emigh about the safe’s contents and he allegedly admitted they belonged to him. Emigh also allegedly admitted to using the substances; he denied selling the substances. Emigh said the cash from the safe was his earnings from cutting fire wood and working with a buddy.
State police seized the contraband found in Emigh’s possession and transported it to the Clearfield barracks. It consisted of 32 bags of suspected synthetic marijuana, one sandwich-sized bag of suspected marijuana, approximately 500 small bags, $739 in cash, a digital scale and three glass smoking devices. State police sent the contraband to the Erie Regional Crime Laboratory for analysis as directed by the Clearfield County District Attorney’s Office.
On April 13, state police received the laboratory’s drug identification report. The report showed that all 32 bags of suspected synthetic marijuana tested positive for the presence of a synthetic Cannabinoid, a Schedule I drug. The contents of the sandwich-sized bag tested positive for marijuana.
Emigh is currently incarcerated in lieu of $25,000 bail.
