Kenney Waives Hearing in Sexual Abuse Case

CLEARFIELD – A 30-year-old Flinton man who has been accused of sexually abusing a 17-year-old Drifting girl waived his right to a preliminary hearing Wednesday at Centralized Court at the Clearfield County Jail.

Richard Allen Kenney, Jr., 30 of Flinton, will face charges of sexual abuse of children, unlawful contact with a minor, corruption of minors and possession of child pornography. He is currently housed in the Cambria County Jail on a probation violation. His bail was set at $2,500 monetary.

According to the affidavit of probable cause, on Oct. 15, Clearfield County Sheriff’s Deputy, Jerry Nevling contacted the Clearfield-based State Police regarding the 17-year-old victim. Nevling reported that she contacted him on Oct. 13 and related she had engaged in a relationship with Kenney a few months prior over the computer.

In addition, Nevling reported that a few weeks after meeting, the victim sent “provocative pictures” to Kenney over her cellular phone at his request. She said she subsequently engaged in a sexual relationship with Kenney at his residence in Cambria County.

She told Nevling that while at the residence, she observed her pictures on the defendant’s computer as well as those of other young, nude females. Nevling said the victim advised that when she attempted to end her relationship with him, Kenney threatened to show her pictures to her father and post them around her school.

On Oct. 16, police interviewed the victim at her school. She related that sometime in late August, Kenney contacted her on “MySpace.” She told police that Kenney left her his phone number and told her she “looked really pretty.” She told police she began talking to Kenny over the computer. She said on Sept. 5, she gave her cell phone number to Kenney, and they began talking and text messaging over the cell phone.

According to the affidavit of probable cause, during Sept. 5 – 11, Kenney asked the victim to send him pictures of her body. She related she took pictures of herself with her cell phone in her bathroom and sent them to the defendant’s cell phone. She said that two pictures showed her topless and two pictures of her in bra and panties. She told police that Kenney also sent her a picture of himself completely nude with an erection.

The victim told police that at approximately 5 a.m. on Sept. 11, Kenney called her residence and said he was in her area. She said the defendant told her to come outside. She went and met with Kenney, who was operating a green Sedan. She related that she believed he was intoxicated and detected an odor of alcohol.

She told police that Kenney told her she was coming with him for the weekend. She said she told him that she had work in the morning and wasn’t able to go. She said he then threatened to show the “provocative pictures” to her father if she did not leave with him. She said he told her that she would call off work. She said she went inside and packed items for the weekend and left with the defendant who drove to his Flinton residence. She said she contacted her employer and told them she would not be into work.

While at Kenney’s apartment, the victim said the defendant pulled up her pictures on his laptop computer. She told police they were accessed from a folder that consisted of her pictures as well as those of other completely nude females. She told police that she recognized one female as being around 17 years of age and from Madera. She also related she knew another female who was under 18 years of age.

“When he needs something, he just ‘calls’ the girls,” the victim told police, according to the affidavit of probable cause. She also said that Kenney had pictures of young girls on his cell phone.

She said on the evening of Sept. 11, Kenney’s friend “Smitty” was at the apartment. She said Kenney told her to tell “Smitty” that she was 19 if he asked about her age. She said that when he asked, she told him 19 years old. She said on Sept. 12, she also told Kenney’s grandmother that she was 19 years old.

The victim told police that she and Kenney engaged in sexual intercourse “a few times a day” from Sept. 11 – 13. She said on Sept. 13, the defendant dropped her off at her workplace. She said she and Kenney remained in contact through text messages from Sept. 14 – 18.

She told police at approximately 10 p.m. Sept. 18, Kenney picked her up at her workplace. She said his grandmother was with him. She said while at Kenney’s apartment on Sept. 19, she and the defendant engaged in sexual intercourse a few times.

She also related that she, Kenney and “Smitty” went to Altoona and smoked marijuana at Kenney’s brother’s apartment. She said Kenney told her that they were all going to the bar and her year of birth was “1987” if she was asked. She told police that “Smitty” drove her and the defendant to a bar called “Fatty’s.”

She said Kenney told her to go to the back door and go to the bathroom for two minutes, while they ordered their drinks. She said when she came out and sat with Kenney and “Smitty” at the bar, the defendant told her to “keep her back to the bartender so he/she couldn’t see her face.”

According to the affidavit of probable cause, on Sept. 24, the victim said she and Kenney had an argument over the phone about her being out with her friends. She said that Kenney told her she had to “go home immediately,” or he was going to show her pictures to her father. She said she told the defendant she had gone home.

She told police that despite the argument, they maintained their relationship. She said she did not visit Kenney for the next two weekends, but the two remained in contact through text messages.

She said on Oct. 9, Kenney picked her up at her school, and they went to his residence for the weekend. She said they had sex numerous times. She told police that “Smitty” came over, and they all traveled to Kenney’s brother’s apartment in Altoona. She said they smoked marijuana, while they were there. She said she and Kenney returned to his apartment and engaged in sex. She said the defendant drove her to her residence on Oct. 11.

According to the affidavit of probable cause, the victim sent Kenney a text, stating she no longer wanted to be with him on Oct. 12. On the same day, she told police she received a voice message from Kenney.

“Yeah, I know you hung up on me. . .and I know you turned your phone off on me. . . I’ll tell you what. . .you want to see a (explanative). . .I’m trying to be nice about this because I love you and really do want to be with you,” Kenney stated in the message.

“. . .You want to start it over at the beginning. . .oh there is no starting at the beginning. . . you try that we’re done. . . and all your fears of your dad getting that picture at work or that picture getting spread around school. . . you don’t call me back. . .It’s 3:06 by 3:10, yeah that’s going to happen.”

On Oct. 15, the victim said that Kenney sent her the following text from his computer to her cell phone.

“I don’t want to sound like a (explanative), but this is just how it’s gonna be. If u hurt me again, it’s over for good, and when it’s over, u know what’s gonna happen wit those pics,” Kenney wrote.

“And when I say hurt me I mean leave me, cheat on me, go drinkin’ without me, talk or hang out with guys, stay out all night and stuff like that I just don’t want hurt again. I love u so much – so what’s up.”

Police indicated that the victim notified them that Kenney’s Pennsylvania driver’s license is currently suspended for driving under the influence. She said that Kenney told her he was 26 years old.
