Public Hearing Set for DuBois Grocery Store’s Request for Liquor License

DUBOIS – A local grocery store’s liquor license request will be the subject of an upcoming public hearing.

On Monday night, DuBois City Council announced that a public hearing will be held at 6:30 p.m. Sept. 23 to discuss Giant Eagle’s request for a liquor license.

According to Councilman Randy Schmidt, a representative from Giant Eagle has indicated that the store would provide seating for 30 people.

It was noted an eat-in location is currently required in order for grocery or convenience stores to sell alcohol in the commonwealth of Pennsylvania.

Councilwoman Diane Bernardo added that the state legislature is considering how it can improve this law and better address this “hybrid situation.”

Then, at 6:50 p.m. Sept. 23, council will hold a public hearing on a proposed conditional use for a property, located on the corner of Liberty Boulevard and Parkway Drive.

According to council, the property owner has plans to convert the former car lot into a retail store for residential and commercial products. The lot is currently zoned for industrial use.

At 6:55 p.m. that evening, council will discuss a request from Verizon to install a small cell tower at 891 Beaver Dr., and likely onto an existing utility pole.

According to council, Verizon will have to pay $300 for an application fee, $1,000 for a zoning permit fee and two years’ worth of rent for the right-of-way use.  With rent at $1,000 annually, the total up-front cost will be $3,300.

At this point, City Solicitor Toni Cherry brought cell phone tower rent to council’s attention. She reminded that an existing entity hasn’t been paying its rent.

As a result, council and Cherry decided to approach the entity and request payment.  If it remains unpaid after a set time period, the tower could possibly be removed by the city.
