YOUNG TWP., Pa. (EYT) – A Jefferson County man is facing criminal charges after he allegedly used a cellular phone to access a woman’s accounts and order sex toys and thousands of dollars worth of shirts with crude statements on them.
Court documents indicate that the Punxsutawney-based State Police filed criminal charges against 25-year-old Daniel F Smith Jr. of Punxsutawney on August 21.
According to a criminal complaint, around 7:30 a.m. on June 6, Trooper Mosier of the Punxsutawney-based State Police spoke with a known victim who stated that a man she had formerly dated, Daniel Smith, used a cellular phone to access various accounts without her permission.
The victim used the phone occasionally when the two were dating but returned it to Smith after they broke up.
Smith allegedly used the phone to send Facebook messages to the victim’s coworkers, changed the passwords on two of her email accounts, shared screenshots of her messages on both Instagram and Pinterest, and posted her Snapchat information on the app “MeetMe” in an effort to have random men contact her.
He also allegedly used the phone to order over $3,000.00 worth of t-shirts and underwear with crude statements on them such as “Sl*t,” “Truck Sl*t,” and “Just Another Sl*t on Birth Control.”
Additionally, he allegedly ordered a sign and a toe ring with crude statements on them, a number of bondage restraints, and various sex toys.
The victim was able to cancel all of the orders except for four of the t-shirts, totaling $70.90.
Trooper Mosier spoke to Smith via phone around 3:10 p.m. on June 6.
Smith stated that he reset the phone to factory settings and sold it after his relationship with the victim ended. He could not remember the date he sold the phone but said it was shortly after they broke up.
Smith said he sold the phone on Craigslist. He also said he did not know the buyer, and that he met the individual at an area Walmart where he claims to have exchanged the phone for $200.
According to the complaint, when questioned about accessing the information, Smith said he didn’t have the phone and had reset it.
He also told Tpr. Mosier that “the bank would pay for the stuff ordered” and “she could send all the stuff back and she wouldn’t be out any money.”
Additionally, Smith allegedly called the victim nine times on June 2 between the hours of 4:09 a.m. and 4:28 a.m. for “no legitimate purpose.”
The following charges were subsequently filed on Tuesday, August 21, in Magisterial District Judge Jacqueline J. Mizerock’s office:

- Identity Theft, Misdemeanor 1
- Harassment – Course of Conduct With No Legitimate Purpose, Summary
Smith is currently awaiting a preliminary hearing.
