Fifth juror dismissed from Colorado movie theater shooting trial

For the fifth time in eight days, the judge in the James Holmes murder trial has dismissed a juror.

Judge Carlos Samour on Wednesday dismissed juror No. 267, saying that person was not forthcoming with him about having recognized a witness who testified on May 5.

This is the fifth juror to be dismissed in the trial, which has run for about seven weeks. Nineteen jurors are left, 12 of whom will decide the case.

Holmes, 27, a former doctoral student in neuroscience, is standing trial on charges of capital murder and other offenses. He is accused of killing 12 people and injuring 70 more at a midnight showing of “The Dark Knight Rises” in Aurora, Colorado, on July 20, 2012. He faces 165 counts. Holmes has pleaded not guilty by reason of insanity.
