Wilson Waives Charges in 2011 Rape Case

CLEARFIELD – A man accused of rape waived his right to a preliminary hearing Wednesday during Centralized Court at the Clearfield County Jail.

The charges against Kyle Andrew Wilson, 21, of the State Correctional Institution at Benner Township, stem from an alleged rape incident involving an 11-year-old girl in March of 2011. He’s been charged with rape of child, statutory sexual assault, aggravated indecent assault and indecent assault.

According to the affidavit of probable cause, the alleged victim walked with Wilson from the Clearfield Area Middle School. The alleged victim told police Wilson asked if she wanted to smoke marijuana and she agreed to. The alleged victim said she walked with Wilson to a wooded area near the baseball fields along Arnold Avenue.

The alleged victim said she continued to walk with Wilson until residences weren’t any longer visible. She alleged that Wilson tripped her, causing her to fall to the ground. She alleged that Wilson proceeded to rape her with his hand over her mouth, so that no one would hear her. The alleged victim said she told Wilson “no” and to “stop.”

After the alleged rape, she said Wilson got up and left her there. She waited until Wilson was far enough away and ran toward the roadway, at which point she called her father to pick her up.

On Jan. 22, police interviewed Wilson about the alleged rape. Wilson admitted to having sex with the alleged victim but claimed she asked him to. On March 11, police took the alleged victim to the area to determine if the rape occurred in Clearfield Borough or Lawrence Township.

Police determined the alleged rape occurred in the wooded area behind the baseball fields on Arnold Avenue, which is in Clearfield Borough. Police noted that Wilson was 17 years old and the alleged victim was 11 years old at the time of the rape incident.
