CLEARFIELD – A Clearfield man who faked a drug overdose has been sentenced in Clearfield County Court.
Kyle Andrew Wilson, 21, 824 Park Ave., Clearfield, an inmate of state prison, pleaded guilty to false alarm, disorderly conduct and possession of a controlled substance.
He was sentenced to 90 days to three years in state prison and one year probation. This sentence will run consecutive to his current sentence that he received in November for a sexual assault case.
The charges stem from an incident in March of 2014 in Clearfield Borough.
According to the affidavit of probable cause, officers were dispatched to a residence for an overdose. They found Wilson, who was on the kitchen floor, acting as if he was going in and out of consciousness. Wilson had a plastic bag with a small amount of a leafy substance in it.
Emergency medical personnel arrived and moved Wilson to an ambulance. An officer observed that Wilson was answering questions too clearly to be suffering from an overdose.
Wilson then admitted he faked the whole thing to make a woman worry about him because they were fighting earlier in the day. Wilson was transported to Penn Highlands Clearfield to be evaluated. He tested positive for marijuana.
This case was scheduled for sentencing in April, but Judge Fredric J. Ammerman continued it to allow time for Wilson to apply for a public defender.
When he appeared via video conference for sentencing he still was unrepresented by counsel. He said he received the application for a public defender but he couldn’t send it back, because he didn’t have an envelope to send it out.
Wilson is currently serving an 18-month to six-year state prison sentenced for statutory sexual assault and indecent assault person less than 16 years old. In that case, he was accused of having sex with a 14-year-old girl. After an evaluation he was determined to be a sexually violent predator.
In April Wilson was charged in another sex case with rape of a child, statutory sexual assault, aggravated indecent assault, aggravated indecent assault of a child, and indecent assault person less than 13 years of age. His preliminary hearing in this case is scheduled for June 3.
According to the affidavit in that case, sometime in March of 2011 when the victim was 11 years old, Wilson raped her. The victim said she was walking from the Clearfield Area Middle School with a friend and Wilson. The friend left and she continued walking with Wilson to a wooded area near Penelec along Arnold Avenue. He allegedly tripped the victim, causing her to fall to the ground. He then raped her.
The victim didn’t tell anyone until she spoke with a therapist recently.
When questioned about this, Wilson claimed the sex was consensual. He also asked investigators, “How long am I going to get for this one?”
