CLEARFIELD – An Osceola Mills man who allegedly assaulted and threatened to shock his son for missing the toilet waived his right to a preliminary hearing during Centralized Court on Wednesday at the Clearfield County Jail.
David L. Bainey, 35, of Osceola Mills has been charged with simple assault, terroristic threats, harassment and possession of incapacitation device. His bail has been set at $50,000 monetary.
According to the affidavit of probable cause, on Aug. 8, state police at Philipsburg contacted the Clearfield barracks to forward information about an alleged crime. The alleged victim, an 8-year-old boy, and his mother had reported the crime at the Philipsburg barracks.
On the same day, the boy had been in the custody of his father, Bainey. The alleged victim missed the toilet and urinated on the floor in the bathroom. After that, Bainey allegedly smacked the boy with his bare hand 20 times or more.
Bainey was also in possession of an electronic incapacitation device, turned it on and tested it in front of the alleged victim. He allegedly told the boy if he didn’t straighten up, he would use it to shock him.
State police at Philipsburg photographed the alleged victim’s injuries. State police observed severe redness on the boy’s rear, as well as scratches and hand marks on his left hip area adjacent to his rear.
“There are black and blue marks all over, and there appears to be more developing as time goes on,” state police stated in the affidavit. “Near the scratch marks on the left hip, there are black and blue marks that appear to match the fingers of an adult handprint.”
