Fugitive Wanted for Missing Court Waives Hearings

CLEARFIELD – A fugitive who was wanted for failure to appear for court in November and who has since been accused in forgery and theft cases waived his right to preliminary hearings during Centralized Court on Wednesday at the Clearfield County Jail.

Timothy A. Henry, 34, of Philipsburg is facing charges in three cases. In the first case, he’s charged with five counts of default in required appearance. His bail is set at $50,000 monetary for that case.

In a second case, he’s been charged with forgery, theft, identity theft and receiving stolen property. In a third case, he’s charged with theft of leased property and receiving stolen property. His bail is set at $25,000 monetary in each case.

According to the affidavit of probable cause in the first case, on Nov. 5, 2012, Henry was required to appear for Colloquy Court for four forgery cases and one theft by deception case.  However, he failed to appear for court, and bench warrants were issued by Clearfield County President Judge Fredric J. Ammerman.

Then, the Clearfield County Sheriff’s Office made several attempts to locate Henry, including at prior addresses. All attempts to locate Henry were unsuccessful. After tracing his cellular phone, Henry was located in Pottsville.

Pottsville police were notified and located Henry; he was placed into custody. On May 14, sheriff deputies transported him back to Clearfield from the Schuylkill County Jail. While en route, Henry admitted to avoiding capture by hiding in a wooded area and watching sheriff deputies, as they searched the housing complex at Edgewood Apartments in Hyde.

According to the affidavit of probable cause in the second case, on the weekend of Feb. 9, Henry removed a book of personal checks from the victim’s residence while staying overnight. He, without knowledge or permission from the victim, filled out the stolen checks and used them for cash withdrawals and purchases, which totaled $1,198.62 coming out of the victim’s checking account.

Henry committed the crime at several places in Clearfield and Centre counties. In committing the crime, he falsely presented himself as the victim while forging his signature. Henry was positively identified by several of the tellers/associates at the businesses, where he’d presented the stolen, forged checks. State police made several attempts to locate Henry but were unsuccessful.

According to the affidavit of probable cause in the third case, on or around March 15, the manager of Rent-A-Center contacted police regarding an Acer Notebook that had been leased to Henry. Henry paid the initial lease payment of $22.78 on the date he’d received the device, which was Dec. 22, 2012. After that Rent-A-Center neither received any additional payments nor responses to notices from Henry.

Police collected the documentation regarding the lease of the involved notebook. This paperwork included the record of certified notice mailed to Henry regarding the return of the involved notebook. The receipt of certified delivery sent on or about Jan. 28 was marked return to sender and dated Jan. 31.

The Rent-A-Center manager reported continued attempts to reach Henry, using the contacts listed by him on their original lease agreement. Her attempts were unsuccessful and didn’t yield any response. Henry’s landlords verified he hadn’t lived at the address used on his lease agreement for approximately one year.

Police conducted a change of address computer inquiry that revealed Henry was wanted by the Clearfield County Sheriff’s Department for failure to appear for sentencing on a forgery-related charge. Police noted additional attempts were made to contact Henry, and they didn’t yield any results.
