Drug Suspect Waives Hearing

news1CLEARFIELD – A man accused of selling marijuana to an undercover state trooper and later found in possession of the drug with related paraphernalia and a loaded pistol waived his right to a preliminary hearing before Magisterial District Judge Richard Ireland during Centralized Court on Wednesday at the Clearfield County Jail.

William James Lunsford, 27, of Clearfield and formerly of Philadelphia, has been charged with manufacture, delivery or possession with intent to manufacture or deliver controlled substance; possession of firearm prohibited; intentional possession of controlled substance by person not registered; and use/possession of drug paraphernalia. He’s currently incarcerated in lieu of $50,000 bail.

According to the affidavit of probable cause, on April 9, state police prepared a search warrant after three, separate controlled purchases of marijuana from Lunsford near his residence between Feb. 12 and April 8. A search warrant was then signed by Ireland’s office, and arrest warrants were obtained for the defendant.

At approximately 6:15 a.m. April 10, state police SERT members executed and served the search warrant on Lunsford at his apartment located at 1789 Turnpike Ave. Lunsford was present at the time and the warrants were then served on him.

State police searched the apartment and found a metal grinder and a marijuana smoking device in the bedroom of Lunsford’s roommate. In Lunsford’s bedroom, state police found the following: a cellular phone with a charger; a black shoe box with paraphernalia; a Ziplock bag with plastic baggies; a box of plastic sandwich baggies; two digital scales; a plastic bag with marijuana; a loaded KAHR 9mm with magazines; four BB guns; a cigarette pack with baggies of marijuana; a black bag with 9mm ammunition; a sandwich bag with marijuana; small Ziplock bags with marijuana; $544 in U.S. Currency; and a letter of indicia.

According to the affidavit of probable cause, the money used by the undercover state trooper to buy from Lunsford on April 8 was previously photocopied. It was compared to the U.S. Currency found in Lunsford’s bedroom. All of the serial numbers for the money used to purchase on April 8 was found at the scene in Lunsford’s bedroom in the pocket of a black sweatshirt that was hanging on the door lock.

Other U.S. Currency was found in the pocket of Lunsford’s jeans that were lying on the bedroom floor. In addition, the loaded 9mm pistol was found in Lunsford’s bedroom next to the wall near a laundry basket. Its serial number ran through clean and had been reported as lost to the Clearfield-based state police. Other seized items were photographed at the scene and transported to the Clarion-based state police, where they were logged into evidence. The controlled substances found in Lunsford’s bedroom tested positive for marijuana.

When interviewed by police, Lunsford claimed that Jennifer Kristofits gave him the pistol. He told police he knew she had reported it as lost to police and told a story that she’d lost it while riding an all-terrain vehicle in the woods.
