Kyle Greogry McLean, 21, 108 Schuyler Hall, Harrisburg, pleaded guilty to possession with intent to deliver, possession of drug paraphernalia and possession of a small amount of marijuana. He was sentenced to two to four years in state prison. He was ordered to complete drug and alcohol counseling and to submit to DNA testing at a cost of $250. He was fined $3 plus costs.
The charges stem from an incident on River Road in Lawrence Township on Nov. 23, 2012. According to the affidavit of probable cause, an officer saw a vehicle with an expired registration speeding on River Road. A traffic stop was initiated. While speaking with the driver, Daniel Clayton Johnson, and two passengers, the officer noticed a strong smell of marijuana coming from the vehicle.
After the officer asked the driver to exit the vehicle, Johnson admitted to smoking marijuana earlier in the day. A field sobriety test was performed and he was arrested for driving under the influence.
Police asked if they could search the vehicle and he consented. During the search police uncovered 2.5 grams of cocaine, 44.7 grams of marijuana, 55.6 grams of marijuana, and 75 MDMA or ecstasy capsules, which all were in a bag in the trunk.
As they were questioned, one of the passengers, McLean, confessed that the items belonged to him. The other two men said they did not have any knowledge of the substances.
Johnson, 22, Harrisburg pleaded guilty to DUI in March and was sentenced to 72 hours to six months in jail.
