Man Waives Hearing in Drug Case

headline2CLEARFIELD – A man accused of selling Suboxone strips and Subutex pills waived his right to a preliminary hearing before Magisterial District Judge James Hawkins on Wednesday during Centralized Court at the Clearfield County Jail.

Derk Allen Anderson, 29, of Grampian has been charged with manufacture, delivery, or possession with intent to manufacture or deliver controlled substance and criminal use of communication facility. Anderson’s bail is set at $50,000 monetary.

According to the affidavit of probable cause, on Nov. 28, 2012, agents of the Attorney General’s office and a confidential informant met about conducting undercover purchases of Suboxone strips from Anderson. The CI said they had been in touch with Anderson via text messages regarding him selling some Suboxone strips to them.

During the text-message conversation, the CI said Anderson offered advice about making “extra money” by selling Suboxone strips.  Anderson told the CI that they could sell the Suboxone strips that they purchased from him (Anderson) for $20 per strip to make a profit. The CI told Anderson they wanted to purchase four Suboxone strips that day.

After completing the order, the CI and an agent went to Anderson’s residence on Ross Road in Grampian. Anderson invited them in and they followed him into a bedroom located next to the living room. Inside the bedroom, the CI asked for four Suboxone strips. The agent observed another male who retrieved several Suboxone strips from his wallet. The male counted out four Suboxone strips and handed them to the CI who turned them over to the agent. The agent then handed the male $60 for the Suboxone strips. Afterward the CI and agent left Anderson’s residence.

On Jan. 24, agents and the CI met about purchasing an amount of Subutex from Anderson. The CI was instructed to place a call to Anderson to arrange a delivery of Subutex to the agent. During the call, Anderson told the CI that he would call him back after he contacted his source for Subutex. Shortly thereafter the CI received a call from Anderson, who needed a ride to apartments near Sid’s Super Submarines in Clearfield. He was going to meet his source there to get the Subutex. Anderson told the CI that three Subutex pills would be $120. The CI was to call when they were close to Anderson’s residence.

Agents and the CI went to Anderson’s residence to pick him up. En route to Clearfield, Anderson told them they would need to drive his source to Wal-Mart to have a prescription filled for Subutex.  Upon arrival Anderson went into an apartment and then came out with another male. They entered the agent’s vehicle and instructed the agent to take them to Wal-Mart. Upon arrival at Wal-Mart, Anderson asked the agent for the money for the Subutex, and the agent handed him $120.

Approximately 10 minutes later, the agent observed the male and Anderson get back into the vehicle. While starting to drive, the agent was handed a small, plastic Ziploc bag containing three, white pills from the male. The agent placed the bag into her jacket pocket and continued to the male’s apartment in Clearfield. Upon arrival the male exited the agent’s vehicle and went inside his apartment. At the same time, Anderson exited, saying he’d be right back that he needed to go into the sub shop for beer. The agents and CI then traveled back to Anderson’s residence where they dropped him off.
