Man Gets Jail for Choice Tobacco Store Burglaries

CLEARFIELD – A DuBois man was sentenced Tuesday in Clearfield County Court for burglarizing the same business twice.

Shane Patrick Stuckey Jr., 24, 912 DuBois St., DuBois, pleaded guilty to burglary and criminal mischief in two cases for his actions at the Choice Tobacco Store in DuBois in November.

He was sentenced by Judge Paul Cherry to three months to one year in jail and four years consecutive probation. He was fined $900 plus costs. As part of his plea agreement, he paid $1,800 in restitution. He must submit toDNAtesting at a cost of $250 and complete 100 hours of community service.

Prior to sentencing, Stuckey said he was sorry for what he had done and told Cherry that his family needs him. Cherry replied that Stuckey wasn’t thinking about his family when he committed these crimes. He pointed out that Stuckey had violated his parole on a previous charge within two months. Stuckey was also sentenced for this violation to serve 90 days in jail before he is eligible for re-parole. The new sentence will run consecutive to his parole violation.

According to the affidavit of probable cause in the burglary cases, Stuckey broke into the store by smashing the glass in the front door.  Once inside a surveillance video captured him putting cigarettes, snuff and lottery tickets into a pillow case.

After Stuckey was identified, a search warrant was served on his residence. There police found cigarettes, snuff, clothing matching the burglar in the video, and the pillow case. When Stuckey arrived home he admitted to both burglaries.

Damage to the business and the loss of merchandise in the first burglary totaled $711.49 and the second totaled $1,007.39.

In September he was sentenced to two days to one year in jail for institutional sexual assault. This charge stems from an incident in August of 2011 while he was employed at the Personal Habilitation Services in DuBois. According to the affidavit of probable cause, Stuckey had been sending and receiving vulgar messages from a patient. In an interview with police, he admitted to having sex with that patient.
