Joseph Luke Allen Kolar, 24, 2048 Green Glen Dr., DuBois, is charged with five counts of aggravated assault, fleeing or attempting to elude police, driving under the influence, recklessly endangering another person, resisting arrest, loitering and prowling at night time, disorderly conduct, simple assault and several summaries. He remains in the Clearfield County Jail in lieu of $5,000 bail.
The charges stem from a traffic stop at 2:30 a.m. on Dec. 30, 2012 in DuBois after Kolar allegedly assaulted a woman. According to the affidavit of probable cause, an officer was on patrol when he saw a vehicle pull out of Sheetz on North Brady Street and travel onto Rose Alley without its lights on. The officer followed the vehicle, which traveled at a high rate of speed and continued down a one-way street the wrong way without its lights on. The driver failed to stop after the officer activated his emergency lights but did respond when the officer used his siren. The vehicle stopped and was only occupied by the driver, Kolar. When the officer talked with him, he noticed the smell of an alcoholic beverage and saw fresh blood on Kolar’s knuckles. Kolar claimed his dog had scratched him.
As they spoke, Kolar became more nervous. By this time, another officer had appeared on the scene. The officer asked Kolar to exit the vehicle, but instead Kolar spun the tires and took off, striking the first officer with the passenger side mirror and shoving him into a snow bank. Because the wheels were turned toward the other officer, he was almost struck as the vehicle drove away.
Kolar traveled on East Long Avenue and North Stockdale Street, before he jumped out of the moving vehicle and took off on foot. The vehicle crossed into the other lane and struck a snow bank. The first officer pursued him and was joined by other officers who arrived to assist him. They yelled at Kolar to stop, but he continued to run. After a while, the officers were able to catch up to him and take him to the ground. He struggled, refusing to be handcuffed. Four officers then managed to get him under control, handcuffed and placed into a patrol vehicle.
Kolar was transported to DuBois Regional Medical Center for a blood test to determine his blood alcohol content. At the hospital, he started making rude comments and acted as if he was going to fight with the officers. He threatened them and stated that he wasn’t going to jail. He stood up, lunging toward the officers. Because of his aggressive behavior, he was taken back to the patrol car and transported to the county jail.
Two of the officers went to Kolar’s residence, where they learned Kolar had assaulted a woman. The victim had a cut lip that was still bleeding, a scratch on the front of her neck, her right eye was swollen and she had another cut on the left side of her face near her cheek bone. There was blood on her clothing.
She told police that she and Kolar got into an argument, as they were traveling on South Brady Street. He got mad, punching her several times in the face. She then punched him back. At some point, he just kept punching her so she covered her face to protect herself. Kolar pulled the vehicle into Sheetz. When he went into the store, she got out of the vehicle and called a friend to pick her up.
