DUBOIS – A DuBois man accused of institutional sexual assault waived his right to a preliminary hearing on Friday.
Shane P. Stuckey Jr. faces the charge of institutional sexual assault.
According to court records, the DuBois City Police Department was asked to contact someone from Personal Habilitation Services in regard to an incident between a patient and caretaker.
A worker at the facility told police that she recently had to terminate Stuckey, who worked there as a caretaker, because he allegedly sent nude text messages of himself, as well as sending and receiving vulgar text messages, from one of the MR patients.
Police learned that the alleged victim is considered a patient/resident and is under 24 hour, one on one care. Police learned that the alleged victim is considered disabled and suffers from intellectual as well as mental issues. The worker told police that the alleged victim also sent nude pictures of herself to Stuckey.
On Sept. 9, police talked with an invetigator from Advocacy Alliance. She told police that the alleged victim admitted to having sex with Stuckey on a few occassions. The alleged victim told the investigator that the sex was not forced. However, the investigator felt that the alleged victim was coerced by Stuckey due to her mental condition. The alleged victim reportedly told the investigator that she did tell Stuckey to stop once, because it was painful, and that he did not.
Both police and the investigator spoke with Stuckey. He reportedly told the investigator that he did have sex with the alleged victim, and he admitted that it was a mistake. He told police that he had sex with her on more than one occassion. He denied forcing sex on her. He told police he was in the process of getting help for his behavior.
