CLEARFIELD – An Imler man was waived his right to a preliminar hearing in a DUI homicide case.
Leonard Dumin faces charges of homicide by vehicle while DUI; two counts of aggravated assault by vehicle while DUI; two counts of recklessly endangering another person; and related DUI charges.
According to court records, state police were called to the scene of an accident on July 1 on state Route 53 in Irvona Borough. A trooper at the scene reported a black Ford Expedition in the south lane of travel, facing north, with front end damage. A brown Suzuki Forenza was also at the scene, off of the east side of the road, also with front end damage. The driver of the Forenza, Marie E. Spicer, was still in the vehicle and was pronounced dead at the scene. A passenger in Spicer’s vehicle suffered serious injuries and was unable to remember anything regarding the accident.
The trooper made contact with the driver of the truck, Dumin, while he was in an ambulance at the scene. He was asked if he was the driver of the truck, to which he replied, “Yes. I was going home. I’m almost home, let me go.” When asked what happened, Dumin told police that he did not know. The trooper could detect the odor of alcohol on Dumin’s breath. His speech was slurred and he reportedly appeared confused.
Dumin was taken to Altoona Regional for treatment. While there, a blood draw was done. Dumin’s BAC 0.26 percent.
A reconstruction of the accident determined that Dumin was at fault for the accident.
