Shaw stated that Barnett is wanted for failure to appear at Criminal Call on Dec. 12, 2002.
On February 22, 2002, Officer Steve Maholtz, of the DuBois City Police Department, filed a criminal complaint charging Barnett with: 1) theft from a motor vehicle, M1, 3 counts; 2)receiving stolen property, M1, 5 counts; 3) theft by unlawful taking, M1, 5 counts; and 4)criminal mischief, S, 5 counts.
An affidavit of probable cause filed by Maholtz states that at on Jan. 25, 2002, the DuBois City Police were dispatched to McCracken Run Road for a reported theft from a motor vehicle being serviced at DuBois Auto Repair. Upon arrival, officers spoke with the victim who stated that she arrived to pick up her vehicle after receiving repairs and noticed that the doors were unlocked and the stereo was missing. Police located a small pair of wire snips and a red handled screw driver on the front seat of the victim’s auto. During the course of investigating the incident, officers determined that four other vehicles at the repair center were broken into and had stereos removed. Police executed a search warrant at a residence in Chapman’s Trailer Parkand recovered the stolen car stereos.
A Preliminary Hearing was held on April 5, 2002, at which time Barnett waived the charges to Court. On Dec. 12, 2002, Barnett failed to appear for Criminal Call and a warrant was issued for Barnett’s arrest.
