Clearfield Borough Council Approves Engine Brake Ordinance

CLEARFIELD – On Thursday Clearfield Borough Council approved an ordinance that was a long time in the making.

Solicitor F. Cortez “Chip” Bell III informed council that PennDOT approved a number of proposed streets for the engine brake/brake retarder ordinance, and if council deemed the ordinance fit, they needed to adopt it.

The ordinance will affect the following streets: Bigler Avenue from the Lawrence Township line to Daisy Street; North Second Street from Bridge Street to East Market Street and Park Avenue from Cody Street to South Second Street.

Bell said that initially it was brought to his attention by Council member Fred Wisor that the ordinance had no teeth. He said that while there were fines in place, there was nothing to really dissuade drivers from using engine brakes. Bell said that a penalty provision was added for each fine that included “and/or up to 90 days in jail.”
