DUBOIS – A DuBois man waived his right to preliminary hearings in two separate cases.
Derek Young faces charges of loitering and prowling at night, resisting arrests and criminal trespass.
According to court records, Young was confronted by police late July 15 after he was spotted wandering around the yard of a William Penn Avenue residence. The resident of the house told police that Young had rang the doorbell and had been looking in through the windows of the house.
Young explained to police that he was trying to find out where a local bartender lived. After questioning, Young admitted that he did not know where the woman lived, nor if she lived at the residence in question.
Young was arraigned by Magisterial District Judge Michael Rudella for loitering and prowling at night time. He was released on bail on the condition he have no contact with the residents of the house.
The next night a person matching Young’s appearance was spotted at the same residence. This time one of the residents found the grill had been turned on, and a lighter that did not belong to them left at the grill. A neighbor also identified the person as the individual who had been at the residence the day before.
After contacting Rudella the police went to pick up Young for violating his bail. Police arrived at Young’s residence to find him wearing clothes matching the de scri ption of the person at the William Penn Avenue residence.
Young denied being at the residence, but was told he was under arrest for violating his bail. At this point Young struck the policeman in the chest knocking him off the porch as the officer attempted to grab Young by the arm. The officer then chased Young into the house, back outside around the house a few times until Young ran back inside and locked the door. During the chase the officer ordered Young to stop several times.
Police entered the house through the unlocked back door and after a second chase were able to subdue Young.
This second series of events added resisting arrest and criminal trespass to the list. Young was originally charged with aggravated assault, which was withdrawn.
